What happened

President Droupadi Murmu has given assent to the Frontier Nagaland Territorial Authority (FNTA) Bill, 2026, according to Chief Minister Neiphiu Rio. In a post on X on 25 October 2026, reported by The Morung Express and Eastern Mirror, he thanked the President for granting assent and the Ministry of Home Affairs for coordinating the process. The reports do not give the date on which assent was granted, and RankVyuh could not find a Gazette notice or official press release on the assent as of 28 October. The law sets up a self-governing territorial authority for six eastern districts of Nagaland, with powers over 46 transferred subjects.

The Act will come into force on a date the state government notifies in the Official Gazette. Rules and an interim council still have to be put in place.

Background

  • The demand: The Eastern Nagaland Peoples' Organisation (ENPO) first formally sought a separate state in 2010. In 2022 it held a rally for a state called 'Frontier Nagaland' and announced an election boycott, which it withdrew after assurances from the Centre. The ENPO traces its concerns over representation, resources and development back to Nagaland's early years as a state.
  • Tripartite agreement: On 5 February 2026 the Government of India, the Government of Nagaland and the ENPO signed a Memorandum of Agreement (MoA). Clause 3.3 of the MoA says the FNTA is to be created by special state legislation, in consultation with the Ministry of Home Affairs (MHA).
  • False start: The first Bill was introduced on 26 March 2026. The state's Advocate General had advised that a state law cannot hand over the legislature's own law-making power. The same evening the MHA said it was still examining whether giving the FNTA legislative powers was constitutional and asked the state to wait. The Assembly returned the Bill on 27 March.
  • Revised Bill: On 6 July the state Cabinet decided to call a special session. The March Bill was withdrawn on 1 September and a revised Bill, moved by Deputy Chief Minister Y Patton, was passed unanimously on 3 September 2026.

The Bill states that Article 371A, the Bengal Eastern Frontier Regulation, 1873, and the region's exemption from Panchayati Raj continue without dilution.

Why the Bill went to the President

Under Article 200, a Governor facing a Bill passed by the state legislature can assent, withhold assent, or reserve it for the President. Under Article 201, the President then assents or withholds assent, and may send a non-Money Bill back for reconsideration. A state Bill reaches the President only when the Governor reserves it, so the assent implies the Bill was reserved. The sources do not report the reservation itself or the Governor's reasons; the MHA had earlier examined whether the FNTA could be given legislative powers.

How it differs from a Sixth Schedule council

The Sixth Schedule (Articles 244(2) and 275(1)) covers tribal areas only in Assam, Meghalaya, Tripura and Mizoram. The Bodoland Territorial Council in Assam works under it, so its powers come from the Constitution itself. Nagaland is not in the Sixth Schedule. The FNTA instead draws its powers from a state law, within the framework of Article 371A.

Why it matters

  • It creates a new level of devolution between the state government and the district for a region that says it has been left behind.
  • It turns a long statehood demand into a negotiated, within-state arrangement.
  • It shows how Article 371A states can use their own laws to manage regional demands.
  • The Governor's power to reserve Bills under Article 200 is a live federal issue, and this is a working example.

Issues and criticism

  • Legal limits: The state's Advocate General advised that a state cannot delegate its own legislative power, and the MHA examined the point for months before the Bill was revised.
  • Fidelity to the MoA: The ENPO repeatedly appealed to the state to uphold the February MoA. ENPO president A Chingmak Chang said the outfit was satisfied with the Bill only "to some extent".
  • Legislators' concerns: The Eastern Nagaland Legislators' Union (ENLU) had sought deferment until its concerns were addressed and the agreement was clarified.
  • Funding: The state asked the Centre to raise the special development package from Rs 5,000 crore to at least Rs 10,000 crore. This is a request, not an approved amount.

Way forward

  • Notify the commencement date and frame rules.
  • Set up the Interim Council, then hold the first elections through the State Election Commission.
  • Transfer staff and funds on time so the 46 subjects are run by the Authority in practice.
  • Settle the size of the Centre's special development grant.
  • Use the 10-year review to judge results.
